These Terms of Service ("Terms") govern your access to and use of the services, platform, and website provided by Expaia SARL ("Expaia," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.

Acceptance

By creating an account, accessing our platform, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using our services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not access or use our services. We reserve the right to update these Terms at any time. Material changes will be communicated via email or a prominent notice on our website at least 30 days before they take effect.

Use License

Subject to your compliance with these Terms and payment of applicable fees, Expaia grants you a limited, non-exclusive, non-transferable, revocable license to access and use our platform and services for your internal business operations.

You may not:

• Sublicense, resell, or redistribute the services to any third party
• Reverse engineer, decompile, or disassemble any part of the platform
• Use the services to build a competing product or service
• Circumvent any security measures, access controls, or usage limits
• Transmit malicious code, engage in unauthorized data scraping, or interfere with service integrity

Service Description

Expaia provides an enterprise AI platform that includes data integration, intelligent analytics, autonomous agents, and workflow automation capabilities. Service availability, features, and performance are governed by the applicable service level agreement (SLA) executed between Expaia and the customer.

We reserve the right to modify, suspend, or discontinue any part of the services at any time with reasonable notice. We will use commercially reasonable efforts to notify you of material changes that may affect your use of the platform.

Limitations

To the maximum extent permitted by applicable law, Expaia and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the services.

Our total aggregate liability for all claims arising under these Terms shall not exceed the total fees paid by you to Expaia during the twelve (12) months immediately preceding the event giving rise to the claim. The services are provided "as is" and "as available" without warranties of any kind, whether express or implied.

Governing Law

These Terms are governed by the laws of the Kingdom of Morocco. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Casablanca.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
